Kevin Porter has asked Manhattan prosecutors to drop second-degree assault charges against him, according to the New York Post. Porter’s defense team said that Porter did not cause his girlfriend to fracture her cervical vertebrae and that the injury was a birth defect of his girlfriend.

The original indictment alleged that Porter’s domestic violence caused his girlfriend to fracture her cervical vertebrae. However, during the trial of the case, Porter’s defense team stated that his girlfriend’s cervical spine fracture was congenital and not the result of domestic violence. The Manhattan District Attorney’s Office also acknowledged this fact.

Currently, Porter’s defense team is asking the District Attorney’s Office to drop the second-degree felony charges against him. If this request is accepted, Porter will face charges of second-degree strangulation and third-degree assault. The strangulation charge carries a maximum penalty of seven years in prison.

Porter’s attorneys say they will continue to work to prove Porter’s innocence. They believe Porter is an innocent victim in this case.
